1. Introduction and acceptance

QRBYT ("we", "us", "our") operates the website www.qrbyt.com and the QR code generation service accessible through it (the "Service").

By accessing or using the Service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the Service. "You" refers both to you as an individual and to any entity you represent.

2. Description of the Service

QRBYT allows you to create, customize, and manage QR codes. We offer two types of QR codes:

  • Static QR codes encode content directly into the QR code image. Once created, they are completely standalone and have no dependency on our Service.
  • Dynamic QR codes route through our Service, allowing you to update the destination content at any time and view scan analytics. Dynamic QR codes require an active account.

You are responsible for maintaining an active account if you rely on dynamic QR codes. If your account is inactive or terminated, dynamic QR codes may stop functioning.

We may modify, add, or remove features of the Service at any time. We will make reasonable efforts to notify you of significant changes.

3. Account registration

To use certain features of the Service, you must create an account. By registering, you agree that:

  • You are at least 16 years of age.
  • The information you provide is accurate and complete.
  • You are responsible for keeping your login credentials secure.
  • You will notify us immediately at contact@qrbyt.com if you suspect unauthorized access to your account.

You are responsible for all activity that occurs under your account.

4. Subscriptions and payments

QRBYT offers paid subscription plans billed through Stripe, our payment processor. We do not store your payment details.

Some plans may include a free trial period. No payment is required until the trial ends.

  • Subscriptions are automatically renewed for the same billing period unless you cancel before the renewal date.
  • By subscribing, you authorize us to charge your payment method for the applicable fees.
  • You can cancel your subscription at any time. You will retain access to paid features until the end of your current billing period.
  • Prices are displayed in the applicable currency. VAT or other taxes may apply depending on your country of residence.
  • We reserve the right to change prices. We will notify you of any price changes before they take effect.

5. Right of withdrawal and refunds

If you are a consumer in the European Union, you have the right to withdraw from your subscription within 14 days of the purchase date, without providing any reason. To exercise this right, contact us at contact@qrbyt.com. We will process your withdrawal and issue a refund to your original payment method within 14 days.

After the 14-day withdrawal period, payments are non-refundable. You may cancel your subscription at any time to prevent future renewals, and you will retain access to the Service until the end of your current billing period.

6. Acceptable use

You agree to use the Service in compliance with all applicable laws and these terms. You may not:

  • Use the Service for any illegal or unauthorized purpose.
  • Create QR codes that link to malware, phishing pages, or harmful content.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service.
  • Interfere with or disrupt the operation of the Service.
  • Impersonate any person or entity.
  • Resell or redistribute access to the Service without our written consent.

You are solely responsible for the content you encode in your QR codes and the destinations they link to.

We reserve the right to suspend or terminate any account that violates these rules, without prior notice. We may also remove or disable access to any content that violates these terms.

If you encounter a QR code created through QRBYT that links to malicious, harmful, or abusive content, you can report it here. We review all reports and take appropriate action.

7. Intellectual property

The Service, including its design, code, logos, and branding, is owned by QRBYT and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

The QR codes you create and the content you encode in them remain yours. We claim no ownership over your content. By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service.

8. Limitation of liability

To the maximum extent permitted by applicable law, QRBYT shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, profits, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claim related to the Service is limited to the amount you have paid us in the 12 months preceding the claim. This limitation applies whether the claim is based on contract, tort, or any other legal theory.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights under EU law.

9. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or meet your specific requirements.

Some jurisdictions do not allow the exclusion of implied warranties. In those cases, the above disclaimer may not fully apply to you.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these terms, or for other legitimate reasons with reasonable notice.

If we terminate your account for a violation of these terms, your access ends immediately. If you cancel voluntarily, you will retain access until the end of your current billing period. Data deletion follows our Privacy Policy.

11. Changes to these terms

We may update these Terms of Service from time to time. We will post the updated version on this page and update the effective date at the top. Your continued use of the Service after changes are posted means you accept the updated terms.
